Apple plans to spend nearly $2 billion on two new data centers in Denmark and Ireland. The centers will run completely on renewable energy, in keeping with Apple’s recent efforts to build cleaner, greener data centers.

I wouldn't expect any favors from the EU with these cheap acts of restitution.
If they EU thinks you owe money, it will say you owe money. Whether you actually should owe anything is debatable, but you don't want to be forced to play EU ball; it's basically a "gambling" version of Calvinball. The EU never loses at EU ball.
